Return and Refund Policy

Thank you for shopping at ANAFRA.

If, for any reason, You are not completely satisfied with a purchase We invite You to review Our Return and Refund Policy.

The following terms are applicable for any products that You purchased with Us. This Return and Refund Policy forms part of Our Terms and Conditions. By using Our Service, you agree to this Return and Refund Policy. To the extent Our Terms and Conditions and/or this Return and Refund Policy are inconsistent with a Sale of Goods Agreement between You and Anafra, the Sale of Goods Agreement shall prevail.

Interpretation and Definitions


Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

 

Definitions

For the purposes of this Return and Refund Policy:

  • Company (referred to as either "the Company", "We", "Us", "the Seller" or "Our" in this Agreement) refers to ANAFRA US LLC, 900 Granby Street, Unit 133, Norfolk, VA, 23510.
  • Defective Goods are those Goods which, in the case of custom data servers, contain significant defects in the Company’s design or assembly thereof, which become apparent within twelve (12) months of delivery; and, in the case of server components (whether sold separately or as part of a custom data server), are defective as defined by the manufacturer’s warranty and for so long as that warranty applies.
  • Goods refers to the items offered for sale on the Service.
  • Nonconforming Goods are those Goods which significantly deviate from the specifications in Your Order.
  • Orders mean a request by You to purchase Goods from Us.
  • Service refers to the Company listing Goods on the Website, maintaining Your Account information through the Website; receiving orders and payments from You through the Website; and processing requests for refunds and returns through the Website.
  • Website refers to https://anafrashop.com
  • Customer (referred to as either "the Customer", "You" or "the Buyer" in this Agreement) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Limited Product Warranties


With respect to any data servers, for a period of twelve (12) months from the date of shipment of the Goods (the “Server Warranty Period”), the Seller’s design and assembly of customized servers will be free from significant defects in workmanship;

Any server components (whether sold separately or as part of a data server) are subject to the manufacturer’s warranty terms and period (the “Component Warranty Period”); and

The Buyer will receive good and valid title to the Goods, free and clear of all encumbrances and liens.

Defective Goods


Defective Goods are those Goods which do not meet the “Limited Product Warranties” But, those limited product warranties do not apply where the Goods become Defective Goods as a result of having:

  1. Been subjected by the Buyer or its contractor to abuse, misuse, neglect, negligence, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental conditions or use contrary to any instructions issued by the Seller; or
  2. Been reconstructed, repaired or altered by the Buyer or its contractor; or
  3. Been used with any Third-Party hardware or product that has not been previously approved in writing by Seller.

The Buyer shall notify the Seller, in writing, of any alleged claim or defect within thirty (30) Calendar Days from the date the Buyer discovers, or upon reasonable inspection should have discovered, such alleged claim or defect (and within thirty (30) Calendar Days before the expiration of the applicable Warranty Period);

The Buyer shall ship, at the Buyer’s expense, such allegedly Defective Goods to the Seller’s Registered Office for inspection and testing by the Seller;

If the Seller’s inspection and testing reveals that such Goods are Defective the Company will:

  1. repair or replace such Defective Goods within thirty (30) Calendar Days, or
  2. credit or refund the Purchase Price of such Defective Goods within fourteen (14) Calendar Days.

Nonconforming Goods


Nonconforming Goods are those which significantly deviate from the specifications in the Order

The Buyer shall inspect the Goods within three (3) Business Days of delivery of the Goods (“Inspection Period”) and either accept or, if such Goods are Nonconforming Goods, reject such Goods.  The Buyer will be deemed to have accepted the Goods unless it notifies the Seller in writing of any Nonconforming Goods during the Inspection Period and furnishes such written evidence or other documentation as reasonably required by the Seller.

If the Buyer timely notifies the Seller of any Nonconforming Goods, the Seller shall determine, in its reasonable discretion, whether the Goods are Nonconforming Goods within thirty (30) Calendar Days. If the Seller determines that the Goods are Nonconforming Goods, it shall at its own discretion select one of the following remedies:

  1. Replace such Nonconforming Goods with conforming Goods within thirty (30) Calendar Days of receiving the Nonconforming Goods from the Buyer,

If the Seller exercises its option to replace Nonconforming Goods, the Seller shall, after receiving the Buyer’s shipment of Nonconforming Goods, ship to the Buyer, at the Seller’s expense, the replaced Goods to the Delivery Location

  1. Refund the Purchase Price for such Nonconforming Goods within fourteen (14) Calendar Days, In either case, the Buyer shall ship, at the Buyer’s expense and risk of loss, the Nonconforming Goods to the Seller’s address: 900 Granby Street, Unit 133, Norfolk, VA, 23510

The Seller's acceptance of such returned Goods will not be deemed an admission that the Goods are Nonconforming Goods and, if the Seller finds that any Goods returned are not Nonconforming Goods, those Goods will be returned to the Buyer at the Buyer’s expense.

Returns Generally


New, used, and refurbished Goods purchased from sellers other than the Company are subject to the returns and refunds policy of that seller.

Goods shipped from the Service can be returned by You to the Company only if they are Nonconforming Goods or Defective Goods. 

Before returning Nonconforming or Defective Goods on which You've saved any private information, erase this information completely by following the manufacturer’s instructions.

Conditions for Returns


In order for Nonconforming Goods to be eligible for a return, please make sure that:

  1. You inspect the Goods and notify the Company of the apparent Nonconformity within three (3) Business Days of delivery.
  2. The Goods are in the original packaging.

In order for Defective Goods to be eligible for a return, please make sure that:

  1. You notify the Company of the alleged defect within thirty (30) days of discovery and thirty (30) days before the end of the warranty period
  2. Such discovery, in the case of a defect in or caused by the Company’s design or assembly of a custom data server, arises within twelve (12) months of delivery.
  3. Such discovery, in the case of a defect in any data server component as defined by the manufacturer’s warranty, arises within 30 days of the end of the period established in that warranty.
  4. The alleged defect was not caused by You.
  5. You have the receipt or proof of purchase.

The following Goods cannot be returned:

  1. Unless otherwise specified, software downloads from the Service are not returnable after purchase.
  2. Goods which according to their nature are not suitable to be returned.Goods which are, after delivery, according to their nature, inseparably mixed with other items Only regular-priced Goods may be refunded. Unfortunately, Goods on sale cannot be refunded.

We reserve the right to refuse returns of any Goods that do not meet the above return conditions in our sole discretion.

Returning Goods


You should send Nonconforming or Defective Goods to the Company at the following address: ANAFRA US LLC, 900 Granby Street, Unit 133, Norfolk, VA, 23510, USA

We cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend that You use an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.

Refunds


When you return an item, your refund method may vary.

If the Buyer timely notifies the Seller of any Nonconforming or Defective Goods, the Seller shall determine, in its reasonable discretion, whether the Goods are Nonconforming Goods or Defective within thirty (30) Calendar Days. If the Seller determines that the Goods are Nonconforming Goods or Defective, it shall either:

  1. Replace such Nonconforming or Defective Goods with conforming Goods within thirty (30) Calendar Days

       or

  1. Refund the Purchase Price for such Nonconforming or Defective Goods.
